GENERAL TERMS AND CONDICTIONS

  1. INTRODUCTION

EverBest Tours – Unique Like You, is a brand under which the company Versão Vibrante, Lda. operates, and hereinafter referred only as “EverBest Tours” or “Us”.

This Agreement sets forth the terms and conditions between EverBest Tours and users who use our site to purchase tours and travel services hereinafter referred as “Costumer” or “You”.

This Agreement states the General Conditions and you must read this before using the Site and book a service/tour. Use of our Website and purchases made through it constitutes an agreement to all terms and conditions in this Agreement and you warrant that you understand, agree to and accept all terms and conditions contained here.

This General Conditions may be altered by Special Conditions or Details related to a specific service provided by EverBest Tours.

  1. GENERAL

EverBest Tours will not be responsible for losses in the event of Force Majeure, such as natural catastrophes, strikes, weather, war or other causes outside of the control of EverBest Tours. Such losses and expenses are the personal liability of the traveller.

EverBest Tours reserves the right to alter routes, itineraries or timetables without prior notice, should it become necessary.

 

  1. DISCLAIMER OF WARRATIES

You expressly agree that the use of this site is at your sole risk. EverBest Tours does not warrant that the site will be uninterrupted or error-free; nor do we make any warranty as to the results that may be obtained from the use of the site, or as to the accuracy, reliability or content of any information, service or merchandise provided through the site. The site is provided on an “as is” basis without warranties of any kind, either express or implied.

 

  1. RESERVATIONS AND SERVICE PROVISION

A booking confirmation and the purchase receive will be electronically sent to the Costumer, which is required to present that receipt, on an electronic device or printed out, when boarding our vehicles.

The day before the tour/service, a contact will be made to arrange details. Anyway, it is the customer’s responsibility to contact our Customer Support at ruilucas@everbesttours.com or phone number +351910802228, regarding the details of his booking – the number of passengers, contact details, pickup time and location. Should the customers fail to contact the Customer Support team in due time, EverBest Tours will not accept any liability for losses or mistakes.

  1. TOUR / SERVICE DESCRIPTIONS

Tours and other services descriptions, format and timings, given on our website or by any other means, aim to present a general idea of the tour / service, and shall not be considered binding. Although we try to ensure the most accurate information, it does not infer any warranties, express or implied, in relation to its correctness, completeness, current, reliability, suitability for any purpose or otherwise (including for any information provided by third parties).
Photographs are meant for illustrative purposes only and do not constitute any contractual agreement between you and us. Timetable and itineraries may vary with the season.

 

  1. PRICES AND PAYMENT POLICY

Please note that prices online can change without notice.

The relevant price for a tour booked through our website(s) is always the one displayed to you during checkout when you enter your name and contact details. The official price catalogue is always the one that is published in our brochure. For the duration of the validity of the brochure, a customer can request to book for this price. The price on our website(s) can differ from the official price catalogue.

 The payment methods available to purchase our services are the below:

  • PAYPAL
  • CREDIT CARD
  • BANK TRANSFER TO OUR IBAN

 

All tours and activities must be fully paid before boarding the vehicle. No payment on the vehicle will be accepted.  On online payments, EverBest Tours uses a third party service to process your credit card information, therefore we have no access to your credit card information.

 

  1. DURATION AND ITINERARIES

Sessions duration are approximate, and are given simply as an indication of the time you will spend at the tour. Some variation for less or more should be expected.

We try to operate all tours as described but we reserve the right to change the tour itinerary if necessary, before or after departure. This type of tours requires considerable flexibility on our and on your part in order to allow necessary changes to the initial itinerary, whether the route, timetables, amenities and means of transportation without notice due to local circumstances or events that may occur that are beyond our control. This may happen due to closing or temporary unavailable roads, monuments, adverse weather conditions, and other unpredictable incidents.

 

  1. PICK UP / ARRIVAL POINTS

The starting or arrival points will be your hotel/accommodation or other agreed place in Porto and it will be indicated on your booking confirmation / voucher.

It is the customer’s responsibility to arrive at the designated pickup location at the exact time indicated on the voucher. Should the customers fail to comply with these conditions, EverBest Tours reserves the right to cancel the booking. EverBest Tours might in single cases grant a free rescheduling or rebooking to the customer, in those cases no refund, be it full or partial, will be issued.

  1. DURING THE TOUR / SERVICE

Our tours are run by a tour Guide/Driver. The decision of the tour Guide/Driver is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip.

It is the costumer’s responsibility to behave according to normal social standards towards the other passengers and the staff while on board and outside the vehicle during the visits. The company reserves the right to refuse or terminate service to any customer, without obligation to explain or provide the reason, in case of unacceptable behaviour (see below cases). Furthermore, the company also holds right to refuse service and any further communication, plus right to communicate with relevant governmental agencies, in any case, pertaining to, but not limited to:

  • Physical, sexual and verbal harassment to staff or any fellow traveller;
  • Threat, libel or slander of staff or any fellow traveller;
  • Physical abuse or harm to others and oneself;
  • Discrimination based on skin colour, race, gender expression and identity, sex, age, religion, and bigotry;
  • Fraud, theft or intention to cheat the company.

 

The Portuguese law requires each passenger to fasten his seat belt while on board. Not complying with the law can lead to expulsion from the vehicle. Booster seats (for children of the age 4-12) and Children’s Safety Car Seats (for children of 2+ years) are available upon request at ruilucas@everbesttours.com .

Customers are given a certain time to visit each site – this time is given by the tour Guide/Driver before exiting the vehicle at each stop. It is the customer’s responsibility to come back to the vehicle on time.

It is the costumer’s responsibility to check the forecasts prior to the tour and dress accordingly. All our tours include short or medium walks from the vehicle to the viewpoints/points of interest. EverBest Tours will not provide any equipment or clothes.

We accept no liability for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our negligence, in which case our liability is limited to a maximum of the tour/service cost.

We are not responsible for any objects stolen, lost or forgotten inside our vehicles. We advise all customers to have travel insurance, as they travel at their own responsibility on tours and transfers.
You must at all times comply with the laws, customs, foreign exchange and drug regulations of our country, and you also agree to travel in accordance with our responsible travel guidelines.

  1. TRAVEL INSURANCE

Personal insurance is not included. We strongly recommend that all customers should take out appropriate travel insurance.

Personal accident insurance, is included in our service, and guarantees:

  • Payment of treatment costs, including hospital treatment, medicines, up to the annual amount of 4 000,00 Euros;
  • Payment of a capital of 22 800,00 Euros in case of death or permanent disability of its clients.

Civil liability insurance is included in our service, and guarantees:

  • 50 000,00 Euros per claim and annuity.

Costumer must be aware that our Personal accident and Civil liability, are only valid in Portugal.

 

  1. PRIVACY POLICY

EverBest Tours is committed to ensuring the privacy of the information you give us. Our Privacy Policy is stated on our website.

Unless you explicitly declare the contrary, you consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

Your posts, comments and reviews in our Facebook and Instagram pages are welcome.

 

  1. CANCELATION, RIGHT TO RETURN AND REFUND POLICIES

For rescheduling, re-booking and cancelling please contact us via e-mail ruilucas@everbesttours.com .

In case of a cancellation of any tour by EverBest Tours (due to unfavourable weather conditions, technical difficulties or else independent of our control), you will be offered to:

  • Either reschedule to another date of your choice (free of charge and provided there is availability);
  • Or rebook to another tour (eventual differences of price, for less or more, to be payed and provided there is availability)
  • Or get a full refund.

All cancellations from customers should be notified via email to  ruilucas@everbesttours.com . The right to refund and percentages are as follows:

  • if a cancellation request from a customer is received with more than 4 days’ notice, a full refund is given;
  • if received between 4 – 2 days’ notice, a 50% refund is given;
  • if received between 48-24 hours’ notice, a 20% refund is given;
  • if received with less than 24-hour notice or if the customers are a “no-show”, no refund is given – the trip will be charged full price;

 

Delayed/cancelled flights:

  • In case of a flight delay that impedes the costumer to show at scheduled time or If the flight is cancelled, the airline is responsible for granting compensation to their customers – no refund will be given.

Sickness/death in the family: 

  • The customers send an email overnight and ask to cancel because they got sick or someone back at home died/got sick. The customers can show a doctor’s note/new plane tickets to support their claim, full refund. If the costumer cannot show the above referred evidences, no refund will be given

However, in specific cases, and as our aim is to fulfil the costumer expectation, EverBest Tours may offer the guest the possibility to reschedule or rebook. This decision is made entirely at the discretion of EverBest Tours and will be taken on a case by case basis.

 

  1. COMPLAINTS

Your feedback about our services/products is very important for us and a way to constantly increase their quality. In the improbable case you experience any problem, you are expected to report that, in the first instance, to your Guide/Driver. If the matter is not then satisfactorily resolved, please get in touch with us at ruilucas@everbesttours.com. or +351910802228.

If, at last, in the unlikely event that things are not resolved to your satisfaction a electronica Complaints Book is at your disposal on our website. Complaints should be reported within one month of the event date.
